Fox Pix is owned and operated by Rockledge Technology LLC ("Rockledge Technology"). In addition to the Terms and Conditions of Use Agreement applicable to your use of any Rockledge Technology LLC site (the "Rockledge Technology LLC Terms of Use"), the following additional terms (the "Fox Pix Additional Terms") will apply to your use of Fox Pix. Your continued use of Fox Pix constitutes your binding acceptance of these Fox Pix Additional Terms and of the Rockledge Technology LLC Terms of Use as well as your acceptance of Rockledge Technology LLC's Privacy Statement. If you do not agree to these terms you may not use this Site. If you accept this Agreement without reading it in its entirety, you are still bound by this Agreement in its entirety.
1. Member Responsibility for Content Posted on Fox Pix Site.
All photographs, text, captions, or other materials ("Content"), posted on Fox Pix are the sole responsibility of the person who uploaded such content. This means that you are responsible for all Content that you upload, post, email, transmit, or otherwise make available via Fox Pix. Although we maintain the right to review, edit, and remove Content from Fox Pix in our sole discretion, we do not control the Content that is uploaded onto Fox Pix and, as such, we do not guarantee the accuracy, integrity, or quality of such Content. You understand that by using Fox Pix, you may be exposed to Content that you find offensive, indecent, or objectionable. Under no circumstances will Fox Pix or Rockledge Technology LLC be liable in any way for any Content, including, but not limited to, the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via Fox Pix.
2. Grant of License.
When you post Content to Fox Pix you choose whether to make that Content "Public" (meaning that such Content will be included in our Community section and will be available and searchable to anyone who visits the Fox Pix site) or "Private" (meaning that such Content will be available only to those who have been given access according to the permissions set by you and will not be indexed or searchable in the Community section of Fox Pix). By posting Public or Private Content to Fox Pix you grant Fox Pix, its affiliates and partners a worldwide, irrevocable, royalty-free, nonexclusive, sub licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute and publish that Content for the purposes of displaying that Content on Fox Pix. In addition, when you post Public Content to Fox Pix, you also grant us a license to distribute that Content, either electronically or via other media, to users seeking to download it through the Fox Pix Desktop or for purposes of other services provided by Fox Pix and to display such Content on Fox Pix affiliated sites, including but not limited to other sites owned and operated by Rockledge Technology LLC. This license shall apply to the distribution and the storage of Your Content in any form, medium, or technology now known or later developed. You may remove Content you have posted on Fox Pix at any time. When you do remove your Content, the license described above will automatically expire.
3. Prohibited Content.
Our goal is to promote the free-flowing exchange of expression relating to members' interests, activities and hobbies while maintaining high standards of respect and decency. In order to attain this goal, and in addition to the Content/action restrictions set forth in the Rockledge Technology LLC Terms of Use, the following Content is prohibited on Fox Pix:
We may examine any Content submitted to Fox Pix at any time and we maintain the absolute right (but not the obligation) to remove Content, edit Content, move Content from "Public" to "Private" status, or modify any album permissions or settings for any reason or no reason, at any time, with or without notice.
4. Your Use of Fox Pix Content
In addition to posting your own Content on Fox Pix, you can also enjoy the thousands of photos in Fox Pix Community. The Fox Pix site includes a combination of Content that we license from third party partners and Content that is created and posted by our users. All of the Content on the Fox Pix site are protected by our copyrights, the copyrights of our partners and/or the copyrights of the user who posted such materials. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display or in any way exploit any of the Content on the Fox Pix site in whole or in part outside of the specific usage rights granted to you from within the Fox Pix Community.
As a Fox Pix user, you may display Fox Pix images on your computer using the Fox Pix Desktop, send the images as Photo Messages and Ecards, view them on mobile devices, and utilize them on or through other services which may be provided by Fox Pix. Exporting the Fox Pix images into any other software product is expressly prohibited. No other distribution of the Fox Pix images is authorized.
You agree to use Fox Pix only for its intended, lawful purposes and in accordance with all applicable laws. You agree not to use Fox Pix in any manner that interferes with its normal operation or with any other user's use and enjoyment thereof. You further agree that you will not access Fox Pix by any means except through the interface provided by Fox Pix and that you will not access Fox Pix from any territory where its contents are illegal.
5. Fox Pix Membership
Fox Pix is privately owned and operated. Membership is available to individuals 18 years of age or older who truthfully and accurately submit all required information (including a legitimate email address), are approved at the sole discretion of Fox Pix, and obtain a unique Fox Pix Username and Password. For the purposes of verifying your identity when you submit a new user registration, you authorize us to access any information about you that is maintained by one or more third parties, including, but not limited to, websites, electronic databases, and credit reference agencies. Fox Pix is not intended as a service for children and therefore persons under the age of 18 may not become a member. Membership is subject to approval and can be denied or terminated for any reason or no reason, at any time, with or without notice. The ability to register for Fox Pix may be terminated or suspended at any time without notice.
6. Responsibility for Maintaining Your Privacy
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Furthermore, you are strongly advised to maintain and protect your privacy by choosing carefully what personally identifiable information you include in Content you post on Fox Pix.
7. Reporting Content Violations
If you believe that any photo on Fox Pix violates these Fox Pix Rules or your copyright you can report such violation by following the procedure enumerated within the Rockledge Technology LLC Terms of Use.
It is often difficult to determine if your intellectual property rights have been violated. We may request additional information before we remove any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove your content along with that of the alleged infringer pending resolution of the matter.
